PHOTOGRAPHY AND VIDEO CONSENT AGREEMENT<\/span><\/strong><\/h3>\n

 <\/p>\n

This Photo and Video Consent Agreement (the “Agreement”) is entered into by and between Lemaiyan Suites, located at Naivasha (“Hotel”), and the undersigned [Staff\/Individual Name], hereinafter referred to as the “Individual.”<\/span><\/p>\n

 <\/p>\n

Purpose of Agreement: <\/span>This Agreement outlines the terms under which the Hotel may use photos, videos, and individual images of the Individual for promotional and marketing purposes, while ensuring compliance with the General Data Protection Rules, the Data Protection Act of Kenya, and the Constitution of Kenya.<\/span><\/p>\n

 <\/p>\n

Consent for Use:<\/span><\/h4>\n

 <\/p>\n

1. <\/span>Scope of Use: <\/span>The Individual hereby grants the Hotel the right to use photos, videos,<\/span><\/p>\n

 <\/p>\n

and individual images taken during the stay at the hotel for promotional purposes. This<\/span><\/p>\n

 <\/p>\n

includes but is not limited to social media pages, brochures, profiles, magazines, and<\/span><\/p>\n

 <\/p>\n

the hotel’s official website. The use of the image and name may also include its<\/span><\/p>\n

 <\/p>\n

distribution to third parties, such as media outlets or partners of the hotel. The<\/span><\/p>\n

 <\/p>\n

individual therefore consents to the collection, use and disclosure of their image,<\/span><\/p>\n

 <\/p>\n

including disclosure to overseas recipients, as outlined. The hotel will take all<\/span><\/p>\n

 <\/p>\n

reasonable measures to prevent unauthorized access. In case of a data breach or<\/span><\/p>\n

 <\/p>\n

unauthorized access, the hotel will promptly notify the individual and take appropriate<\/span><\/p>\n

 <\/p>\n

steps to remedy the situation.<\/span><\/h4>\n

 <\/p>\n

The intellectual property (including copyright, trademark, and other related rights) of any data and\/or information covered by this consent form shall be assigned to the hotel and will become the property of hotel.<\/span><\/p>\n

 <\/p>\n

The individual waives any right to approve the finished product or products or the advertising copy or printed matter that may be used in conjunction therewith or the use to which it may be applied.<\/span><\/p>\n

 <\/p>\n

2. <\/span>Duration of Use: <\/span>The Individual agrees that the Hotel may use the images for an<\/span><\/p>\n

 <\/p>\n

indefinite period unless otherwise specified in writing. The Individual may revoke this<\/span><\/p>\n

 <\/p>\n

consent at any time in writing.<\/span><\/h4>\n

 <\/p>\n

3. <\/span>Protection of Personal Data: <\/span>The Hotel agrees to comply with the General Data<\/span><\/p>\n

 <\/p>\n

Protection Rules, the Data Protection Act of Kenya, and the Constitution of Kenya in<\/span><\/p>\n

 <\/p>\n

the collection, processing, and storage of any personal data associated with the images.<\/span><\/p>\n

 <\/p>\n

4. <\/span>Limitation of Use: <\/span>The Hotel agrees not to use the images in a manner that could be<\/span><\/p>\n

 <\/p>\n

deemed defamatory, obscene, or in violation of any applicable laws.<\/span><\/p>\n

 <\/p>\n

Revocation of Consent: <\/span>The Individual reserves the right to revoke this consent at any time by providing written notice to the Hotel. Upon receipt of such notice, the Hotel will cease using the images for promotional purposes.<\/span><\/p>\n

 <\/p>\n

Release and Indemnification: <\/span>The Individual releases and discharges the Hotel from any claims, liabilities, or demands arising out of or in connection with the use of the images, including any claims for defamation, invasion of privacy, or infringement of any personal or proprietary right.<\/span><\/p>\n

 <\/p>\n

No Compensation:<\/span><\/h4>\n

 <\/p>\n

The Individual member acknowledges that they will not receive any compensation for the use of their images, videos, or likeness as outlined in this Agreement.<\/span><\/p>\n

 <\/p>\n

Confidentiality: <\/span>The Hotel agrees to treat all personal data associated with the images as confidential and will not disclose it to any third party without the express written consent of the Individual.<\/span><\/p>\n

 <\/p>\n

Governing Law: <\/span>This Agreement shall be governed by and construed in accordance with the laws of Kenya.<\/span><\/p>\n

 <\/p>\n

Entire Agreement: <\/span>This Agreement constitutes the entire understanding between the Hotel and the Individual regarding the use of images and supersedes any prior agreements or understandings, whether written or oral.<\/span><\/p>\n

<\/h4>\n

CONSENT ACKNOWLEDGEMENT:<\/span><\/h4>\n

 <\/p>\n

I, the undersigned Individual, have read and understood the terms of this Photography and Video Consent Agreement. By signing below, I voluntarily consent to the use of my photographs, videos, and individual images by Lemaiyan Suites for promotional and marketing purposes as described herein.<\/span><\/p>\n
